Terms of Service

1. Agreement

By installing or using the PinPoint app ("the App") in a Freshdesk account, you ("the Customer") accept these terms. If you are installing on behalf of an organisation, you confirm you are authorised to accept them for it.

2. Licence

The Publisher grants the Customer a non-exclusive, non-transferable, revocable licence to install and use the App in the Customer's own Freshdesk accounts, for the Customer's internal business purposes, for as long as it remains installed.

The Customer may not resell, sublicense or redistribute the App, present it as its own product, or remove or obscure attribution required by the map and geocoding providers the App uses.

3. Price

The App is provided free of charge. The Publisher may introduce paid versions in the future; any such change will apply only to new versions and will be announced in the listing before it takes effect.

4. What the Customer is responsible for

• A valid Freshdesk subscription and compliance with Freshworks' own terms.
• The ticket custom fields the App writes to, and their configuration.
• The API key supplied at install time, including its permissions and rotation.
• The lawfulness of storing location data about the Customer's requesters, and the corresponding notices and data-subject processes (see the privacy policy).
• Compliance with the terms of any geocoding or map tile provider configured in the App settings, including OpenStreetMap's usage policies when the defaults are kept. Heavy automated use of the free OpenStreetMap services is not permitted by those policies; the Customer is responsible for configuring an appropriate provider for its volume.

5. Third-party services

The App displays maps and resolves addresses using services chosen in its settings: by default the OpenStreetMap Nominatim geocoder and the OpenStreetMap tile servers, plus the jsDelivr CDN for the Leaflet libraries. Those services are operated by third parties, under their own terms, and the Publisher does not control their availability, accuracy or content.

6. Accuracy of location data

Geocoding results and map imagery are estimates provided by third parties. They may be incomplete, out of date or wrong.

The App must not be relied on as the sole basis for emergency response, navigation, dispatch of personnel into hazardous situations, legal boundary determination, or any decision where an inaccurate location could cause injury, loss or liability. The Customer must verify a location by other means before acting on it in such cases.

7. Warranty disclaimer

The App is provided "as is" and "as available", without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. The Publisher does not warrant that the App will be uninterrupted, error-free, or compatible with future versions of Freshdesk or of the third-party services it uses.

8. Limitation of liability

To the maximum extent permitted by law, the Publisher is not liable for any indirect, incidental, special, consequential or punitive damages, nor for loss of profits, revenue, data, goodwill or business interruption, arising out of or in connection with the App, even if advised of the possibility. The Publisher's total aggregate liability under these terms is limited to the greater of the amount the Customer paid for the App in the twelve months before the claim, or USD 50.

Nothing in these terms excludes liability that cannot lawfully be excluded.

9. Support

Support is provided on a reasonable-efforts basis, through the contact page. There is no contractual response-time commitment. Bug reports should include the Freshdesk plan, the app version, the steps to reproduce the problem, and any message the App displayed.

10. Data protection

Data handling is described in the App's privacy policy, which forms part of these terms. The App has no backend: it reads and writes only within the Customer's own Freshdesk account, and sends address text only to the configured geocoding host.

11. Changes and termination

The Publisher may update the App and these terms; continued use after an update constitutes acceptance of the revised terms. The Customer may terminate at any time by uninstalling the App. The Publisher may terminate the licence if the Customer breaches these terms, or may discontinue the App with reasonable notice in the listing. Coordinates already written to the Customer's ticket fields remain in the Customer's account after termination.

12. Governing law

These terms are governed by the laws of the Federative Republic of Brazil, without regard to conflict-of-law rules, and the courts of São Paulo, Brazil have exclusive jurisdiction, except where mandatory local consumer or data-protection law grants the Customer a different forum.

13. Third-party attributions

The App bundles no third-party code but loads, from a CDN, Leaflet (BSD 2-Clause) and Leaflet.markercluster (MIT), whose licences and attributions apply. Map data displayed with the default configuration is © OpenStreetMap contributors, available under the Open Database Licence.
